The UN Charter as the Constitution of International Community

Document Type : Research Paper

Abstract
The highest and most fundamental document in every legal system is the constitution which reflects the major goals and concerns of that system. The other legal documents should be in conformity with this basic document. Within the nation-states, this document, known as the common covenant of the nation, is the basis and legal foundation of the state and plays a key role in maintenance of national integrity and stability.
The present article examines the characteristics of constitutions and compare them with characteristics of the UN Charter as a global treaty which is a unique one, due to the number of its members and its geographical extension. It also analyzes the role of the UN Charter as a universal legal document which could be considered the constitution of the world community.
