The Strait of Hormuz has long been one of the world's most critical strategic waterways due to its geographical location, its role in connecting the Persian Gulf to the Sea of Oman and the open seas, its significance for the transport of energy and goods, and its position at the epicenter of historical and contemporary rivalries among regional and extra-regional powers. Recent security developments and shifting regional conditions have highlighted the need to re-examine the principles, mechanisms, and arrangements governing passage through this waterway. Employing an analytical-strategic approach and drawing upon library resources, legal documents, and historical data, this study investigates the historical, legal, and geopolitical grounds upon which Iran could move to redefine passage arrangements in the Strait of Hormuz. The study’s central argument is that a combination of factors—including Iran’s historical presence and exercise of sovereignty in the Persian Gulf and Sea of Oman, the Strait’s unique geographical position, principles of customary international law, the coastal state's sovereignty over its territorial sea, historical rights, relevant judicial precedents, and security shifts resulting from fundamental changes in circumstances—provides a robust and logical basis for revising past arrangements. In this context, the article distinguishes between conditions of war and direct threats, on the one hand, and stable peacetime arrangements, on the other. The research concludes that the sustainability of any new passage arrangements in the Strait of Hormuz depends, above all, on transforming rivalry and foreign intervention into cooperation among coastal states.
