وزارت امور خارجه فصلنامه سیاست خارجی 23829680 31 1 2017 05 22 International Law Prospective on the JCPOA and Post-JCPOA برجام و پسابرجام از دیدگاه حقوق بین‌الملل 51 73 26462 FA Journal Article 2017 07 16 Joint Comprehensive Plan of Action (JCPOA) was a final conclusion of the long term negotiations of  the Ministres of Foreign Affairs of 5+1 and the I.R. of Iran which was signed  in 14 July 2015 ( 23 Tir 1394). Following the JCPOA and after just six days, the United Nations Security Council adopted the resolution 2231 in 20 July 2015 ( 29Tir 1394), which according to, all previous resolutions of the United Nations Security Council terminated and Security Council asked all parties of the JCPOA to implement the action plan completly. Disloyalty of the US, perticularly at the begining of the presidential term of Donald Trump have shown lack of good faith in implementation of   international commitments pertaining to the JCPOA. Furthermore, since the Res2231 reiterates necessity of full- implementation of the DOC and prohibits any weakining action, as EU and Russia believe, expressions of president Tump and some actions of USCongress not only may weaken the JCPOA but also contradict it’s spirit, and binding UNSC Res- 2231. برنامه جامع اقدام مشترک (برجام) با توافق نهایی وزرای امور خارجه 5+1 و وزیر امور خارجه جمهوری اسلامی ایران در تاریخ 23 تیرماه 1394 (14 جولای 2015) به امضا رسید.متعاقب امضای این سند و تنها پس از شش روز، در تاریخ  29 تیرماه 1394 (20 جولای 2015)، قطعنامه 2231 شورای امنیت به تصویب رسید که بر اساس آن، تحریم‌های قبلی شورای امنیت ملغی شده و کشورهای امضا کننده برجام، موظف به اجرای کامل تعهدات مندرج در آن شدند. بدعهدی‌های ناشی از عدم حسن نیت طرف‌های غربی و بویژه آمریکا در ماههای پس از اجرایی شدن برجام و به شکل ملموس‌تر پس از آغاز ریاست جمهوری ترامپ، در تعارض با حسن نیت در اجرای تعهدات بین‌المللی برجام بوده و با توجه به تأکید قطعنامه 2231 شورای امنیت بر ضرورت اجرای کامل برجام و خودداری از هرگونه اقدام تضعیف کننده این سند همکاری، اظهارات رئیس جمهور آمریکا و برخی اقدامات انجام شده توسط تیم وی و کنگره این کشور در خصوص برجام، همانگونه که اتحادیه اروپا و کشورهای اروپایی و روسیه نیز بر آن اذعان دارند،  تضعیف کننده این سند و مغایر با روح برجام و قطعنامه الزام‌آور 2231 محسوب می‌گردد.   <strong> </strong> https://fp.ipisjournals.ir/article_26462_58b311abb1f038c7371016670f355608.pdf
